These terms are an agreement between you and Nodex Invest OÜ, registry code 16586212, Tüve 7, 13418 Tallinn, Estonia (“we”, “us”), the maker of FaxBuddy. By using the app you accept them. Apple’s Standard End User License Agreement also applies; where the two differ, these terms apply to the service and Apple’s to the app licence.
The service
FaxBuddy lets you send documents from your iPhone to fax machines in the countries listed in the app. We pass your fax to a telecom provider, who delivers it over the phone network. We don’t offer receiving faxes.
Credits
- One credit sends one page to one recipient. Cover pages are free.
- You buy credits as in-app purchases through Apple. Prices are shown in the App Store before you buy.
- Credits don’t expire, can’t be exchanged for money and can’t be transferred to another person.
- Credits are used when a fax is sent or scheduled. If a fax isn’t delivered, or you cancel a scheduled fax before it’s sent, the credits come back to your balance automatically.
- Each iPhone gets one free page, once.
Refunds
Undelivered faxes are refunded in credits, as above. Payments are handled by Apple, so refunds of money are requested from Apple at reportaproblem.apple.com under Apple’s rules. If Apple refunds a purchase, we remove those credits. Nothing in these terms limits the rights you have under consumer law where you live.
Delivery
We send every fax promptly and show you whether it was delivered. “Delivered” means the receiving machine confirmed it received the pages. We can’t guarantee delivery: the receiving machine may be busy, off, out of paper or not a fax machine, and the phone network can fail. We aren’t responsible for the content of what you send, or for what the recipient does with it. Check the number before sending; a fax sent to a wrong number that answers as a fax machine counts as delivered.
For important deadlines, send early and keep the delivery receipt.
Your account
The app creates an anonymous account on your iPhone. You’re responsible for your iPhone and for faxes sent from it. If you delete your account, your unused credits are lost.
Fair use
You may only send documents you have the right to send. Don’t use FaxBuddy to:
- send unsolicited advertising (“junk faxes”) or bulk faxes to people who didn’t ask for them;
- send anything unlawful, threatening, harassing or fraudulent, or that infringes someone else’s rights;
- overload, probe or interfere with the service, or use it in an automated way.
We may block faxes or suspend accounts that break these rules, and we’ll cooperate with authorities where the law requires.
Your documents
Your documents remain yours. You allow us and our providers to process them only to deliver your faxes. How we handle them is described in our Privacy Policy.
Changes to the service
We may change or stop features, or change the countries we fax to. If we ever shut FaxBuddy down, we’ll give at least 60 days’ notice in the app so you can use your credits, and refund unused credits where the law requires.
Liability
The service is provided as is. To the extent the law allows, we aren’t liable for indirect or consequential losses, such as a missed deadline, and our total liability to you is limited to what you paid us in the 12 months before the claim. We don’t limit liability for death or personal injury caused by negligence, for fraud, or for anything else that can’t be limited by law.
Law and disputes
These terms are governed by the laws of Estonia. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts. Please contact us first at support@faxbuddy.app; most problems are solved quickly that way.
Changes to these terms
We may update these terms. We’ll change the date at the top, and tell you in the app if a change matters. If you keep using FaxBuddy after that, the new terms apply.
